Collaborative Divorce – a Non-Adversarial Divorce Process

Collaborative law is a relatively new alternative to divorce litigation and is quickly growing in its popularity. In a collaborative divorce, both individuals select a collaborative divorce attorney who is committed to not go to court. The attorneys actually sign an agreement that should the couple decide to move the divorce to court, they will withdraw from the case. There are no court proceedings, no depositions and no subpoenas.

Collaborative divorce is a transparent process that allows the couple, both attorneys and other participating professionals to meet together so that informed decisions can be made efficiently and any disputes that arise can be resolved in a civil and respectful manner. Because divorce is comprised of legal, financial and emotional issues, neutral financial and mental health professionals are included as part of the collaborative team. Financial needs, facts and information are shared with the financial professional who in turn prepares various schedules to address the couple’s needs. The mental health professional is utilized to facilitate the communication in the process, manage the emotional content, assist in the development of a parenting plan and educate/model healthy co-parenting skills and communication.
